User Agreement and License

This agreement constitutes a legally binding contract between you, the customer, and us here at PossumCraft. If you do not agree to any of these terms, please do not purchase our products. This license shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

Conditions

• Nothing in this license shall affect the User’s statutory rights as a consumer.
• This license shall apply to all contracts for the sale of Goods by PossumCraft to the User and shall prevail over any other documentation or communication from PossumCraft.
• Acceptance of delivery of the Goods shall be deemed conclusive evidence of the User’s acceptance of this license.
• Any variation to this license (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

Ordering

• All orders for Goods shall be deemed to be an offer by the User to purchase Goods pursuant to this license and are subject to acceptance by Possumcraft.
• PossumCraft reserve the right to choose not to accept any order for any reason.

Delivery

• Products will be supplied via a download link and individual password upon receipt of confirmed funds following a purchase.
• Download links will be available for a duration of 30 days, after which time the link provided will become void. Users may reactivate their download link subsequent to the 30 day period by contacting PossumCraft technical support.
• Products will usually be supplied within 1 working day, but PossumCraft shall not be liable for delays beyond this estimate.

Refunds

• Digital Products are easily replicated. For this reason we take measures to prevent and detect unauthorized copying and distribution of our media, artwork, and template products.
• Refunds on Digital Products are contingent on PossumCraft being satisfied that no such replication, copying and redistribution activities have taken place.

License

• The license you purchase authorises a single installation of the purchased product on one individual website. Multiple installations require purchasing an additional license.
• You may use our products for commercial and non commercial websites.

Modification and distribution

• Distribution or Redistribution of Products in any form is not permitted.
• You may not use any product from PossumCraft, in whole or in part, to create your own products for resale.
• Exchange of this package in any form is not permitted.
• Acquiring this package in any form is not permitted other than through PossumCraft directly.
• Translations are permitted for personal usage only in compliance with all terms of this license.
• All copyright, credit and display notices must remain visible and must remain intact in all locations as set as default.

Age of Consent

• Where Goods may only be purchased by persons of a certain age the User will be asked, when placing an order, to declare that they are of the appropriate legal age to purchase the Goods.
• If PossumCraft discovers that the User is not legally entitled to order certain Goods, PossumCraft shall be entitled to cancel the order immediately, without notice.

Your Contact Details

• PossumCraft will not distribute your details to any third party.
• PossumCraft will only use your contact details to provide you with relevant information and support directly related to your purchase.

Limitation of Service

• You acknowledge and accept that modifications made by the user will be supported at the sole discretion of PossumCraft.
• You acknowledge and accept that removal of copyright notices will invalidate your license and any entitlement to support.
• Except as may be implied by law where the User is dealing as a Consumer, in the event of any breach of this license by PossumCraft the remedies of the User shall be limited to damages which shall in no circumstances exceed the Price of the Goods originally purchased, and PossumCraft shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatsoever.

Rights of PossumCraft

• PossumCraft reserves the right to adjust the price and specification of any item on the Website at its discretion.
• PossumCraft reserves the right to withdraw any goods from the Website at any time.
• PossumCraft shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.
• PossumCraft shall be entitled to change these Terms and Conditions at any time.

Waiver

No waiver by PossumCraft (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

Severance

If any term or provision of this license is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if this license had been agreed with the invalid illegal or unenforceable provision eliminated.
